Terms of Service
1. Scope and Acceptance
These Terms of Service ("Terms") govern your use of the Oscillo mobile application ("App") and any related services, including cloud synchronisation, subscription features, and the social feed.
By creating an account or using the App, you agree to these Terms. If you do not agree, you must not use the App.
2. Eligibility
You must be at least 16 years of age to use the App, in accordance with Article 8 of the EU General Data Protection Regulation (GDPR). By using the App, you confirm that you meet this age requirement.
3. Account Registration
You may register using Apple Sign-In or Google Sign-In.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information during registration and to keep your account information up to date.
You may choose a username that will be visible to other users. Usernames must not be offensive, misleading, or infringe on the rights of others.
4. Description of the Service
Oscillo is a watch timegrapher application that analyses mechanical watch tick sounds to measure timing accuracy. The App provides:
- Audio-based timing measurement and analysis
- Camera-based watch identification
- Local and cloud-synchronised watch collection management
- Wrist log tracking
- Social features including a feed, posts, and interactions
- AI-generated stylised watch thumbnails
Features may change, be added, or be removed at any time.
5. Subscriptions and In-App Purchases
Certain features of the App may require a paid subscription or one-time in-app purchase.
Subscriptions are billed through Apple's App Store. Payment, renewal, and cancellation are governed by Apple's terms and policies.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
You may manage or cancel your subscription at any time through your Apple ID account settings.
Refunds are handled by Apple in accordance with their refund policies.
As an EU consumer, you acknowledge that digital content delivery begins immediately upon purchase. You may still exercise your right of withdrawal within 14 days of purchase, unless you have expressly consented to the immediate provision of the digital content and acknowledged the loss of the right of withdrawal.
6. User Content
You retain ownership of any content you create or upload through the App, including watch photos, posts, and comments ("User Content").
By posting User Content, you grant Oscillo a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your User Content solely for the purpose of operating and improving the App.
You must not post content that is illegal, harmful, abusive, defamatory, or infringes on the intellectual property rights of others.
Oscillo reserves the right to remove any User Content that violates these Terms.
7. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorised access to the App, its servers, or any connected systems
- Interfere with or disrupt the integrity or performance of the App
- Upload malicious code, viruses, or harmful data
- Scrape, harvest, or collect data from the App or other users without consent
- Impersonate any person or entity
- Use the App in any manner that could damage, disable, or impair the service
8. Intellectual Property
The App, including its design, code, graphics, and trademarks, is the property of Oscillo and is protected by applicable intellectual property laws.
These Terms do not grant you any rights to use Oscillo's branding, logos, or trademarks.
9. Data Protection and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable German data protection law (BDSG).
By using the App, you acknowledge that certain data (including watch measurements, photos, and usage data) may be stored on servers located within the European Union.
10. Availability and Modifications
Oscillo strives to maintain the App's availability but does not guarantee uninterrupted or error-free operation.
We may modify, suspend, or discontinue the App or any part of it at any time, with or without notice.
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify you of material changes through the App or by email.
11. Limitation of Liability
To the extent permitted by law, Oscillo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
Nothing in these Terms excludes or limits liability for fraud, gross negligence, wilful misconduct, or any other liability that cannot be excluded or limited under German law (Section 309 No. 7 BGB).
The timing measurements provided by the App are for informational purposes only and should not be relied upon as a substitute for professional watch servicing or certified timekeeping assessment.
12. Termination
You may delete your account at any time through the App's settings.
Oscillo may suspend or terminate your account if you violate these Terms or engage in conduct that is harmful to other users or the service.
Upon termination, your right to use the App ceases immediately. Data deletion will be handled in accordance with our Privacy Policy.
13. Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For EU consumers: You may use the European Commission's Online Dispute Resolution platform at https://consumer-redress.ec.europa.eu to resolve disputes.
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle) pursuant to the German Consumer Dispute Resolution Act (VSBG).
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
